Lottabody® Lottastyle Contest ("the Contest") beginning on June 1, 2010 and ending November 30, 2010. The geographic area of this Contest is the United States (excluding Puerto Rico and Guam). Eligibility is limited. See restrictions below. The sponsor of this Contest is Roux Laboratories, Inc. d/b/a Colomer USA ("Sponsor") P.O. Box 37557, Jacksonville, FL 32236. Void where prohibited. Participants agree to these Official Rules.
Eligibility: To enter, you must be 18 years of age or older, a legal resident of the United States (excluding Puerto Rico and Guam). Employees of Sponsor, any of the Competition Judges, and their immediate family members and household members are not eligible to enter. Immediate family includes only spouses, parents, siblings and children.
Prizes: Sponsor will award the following prizes: Six (6) grand prize winners will each receive: (i) Five hundred ($500) cash, (ii) Beauty Basket - $100 worth of beauty products, (Approximate Retail Value of the grand prize is $650)
Prize Restrictions: Winners are responsible for any applicable federal, state, and local or other taxes. Manufacturer, brand, model, color and options of merchandise prizes are subject to change. No substitution, cash alternative, or transfer of non-cash prizes is permitted, except that Sponsor may substitute a prize of equal or greater value if it deems necessary.
To Enter: Between June 1, 2010 and November 30, 2010, take two (2) 4 x 6 to 8 x 10 size photographs of yourself. Each photo must be of different shots of you, and no other person or persons may appear in the photo. At least one (1) of the photos must include a Lottabody brand product with the front label of the product prominently featured in the photo. No slides or negatives will be accepted. No touch-ups or enhancements to either photo are permitted.
Failure to properly execute and timely return the Affidavit will result in disqualification and forfeiture of the prize.
Sponsor is not responsible for lost, late, delayed, damaged, stolen, misdirected, postage-due, illegible or incomplete entries. You may enter as many times as you like. All entries, photos must be unpublished original works and must not violate the rights of any person or entity. TOUCH-UPS ARE PROHIBITED. All entries and photos become the property of Colomer and will not be returned. Entrants hereby perpetually and irrevocably assign, transfer, and quitclaim any and all ownership or authorship rights such rights in the entries and all accompanying photographs to Sponsor.
Selection of Winners: On or about December 15, 2010, or within a reasonable time thereafter, six (6) grand prize winners will be selected in the following manner: a panel of judges comprised of Shawn Tollerson – Vice President, Marketing – Colomer USA, Cindy Adams – Master Hair Stylist, and Teneya Gholston – Brand Manager, Colomer USA will judge the entries using the following criteria: (i) originality, (ii) photographic quality iii) composition, and (iv) creativity of hairstyles within both photos. In the event of a tie between one or more entries, a tie-breaking round of voting will be conducted in which judges rank the tied entries on the basis of the aforementioned criteria. Sponsor reserves the right to substitute one or more judges if it deems necessary.
Notification of Winners: Winners will be announced on January 15, 2011, or within a reasonable time thereafter. Winners will be notified by express delivery service with signature required. Merchandise prizes will be delivered via United States Postal Service. Unclaimed or returned as undeliverable prizes will be forfeited and awarded to an alternate winner.
Publicity Release: By accepting a prize, winners consent to the use by Sponsor and its affiliates of their name, photograph, likeness, biographical information, voice and details of winning in any media, for any purpose, including advertising or promotional purposes, without further compensation, except where prohibited.
Copyright Release: By submitting an entry, entrant grants to Sponsor an irrevocable and unlimited license to publish and display the photos, along with the information provided during entry, in any media now known or hereafter created, including in connection with any of Sponsor’s or Hype Hair Magazine's publications, without further compensation.
Liability Release: By entering the Contest, each participant agrees (a) to follow these Official Rules and (b) to release, discharge, and hold harmless Sponsor, Colomer USA, their parent companies, affiliates, subsidiaries, franchisees, agents, advertising companies and promotional agencies, together with the present and future officers, agents, employees and representatives of each of them, from any and all claims, demands, or damages relating to or arising from t/he Contest or the acceptance and usage of any prizes.
Miscellaneous: Sponsor reserves the right, at its sole discretion, to disqualify any individual from the Contest it reasonably suspects or believes to be tampering with or undermining the Contest process or operation, by any means, or to be acting in violation of these rules. Any person attempting to defraud or tamper with this Contest in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. All interpretations of these Official Rules shall be made by Sponsor or its designated Judges, whose decisions and interpretations shall be final and binding. Sponsor may cancel or suspend all or any part of this Contest if it determines that the Contest is incapable of being run fairly or securely because of reasons beyond Sponsor's control. Sponsor reserves the right to correct typographical, clerical or printing errors in any Contest materials. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by human errors or omissions, natural disasters, data transmissions or any other means; is not responsible for contacting any participant by any means if that participant has changed contact information and fails to provide Sponsor with the new contact information.
Winners' List: For a list of winners, mail a self-addressed stamped envelope to "Lottabody® Lottastyle Contest" attn: Winners List c/o Colomer USA at P. O. Box 37557, Jacksonville, FL 32236. Vermont residents may omit return postage.
